Justice Ginsburg’s Persuasion Could Determine The Supreme Court’s Healthcare Ruling

Cutting through the rhetoric displayed during the three days of oral arguments on Obamacare (DHHS, et al v. Florida, et al, Case No. 11-398) at the Supreme Court March 26-28, it is clear the Justices and both litigants are in 99% agreement.

The Supreme Court’s decision to uphold The Patient Protection and Affordable Care Act rests on whether the justices deem the mandate to be a “necessary and proper” tool under the Commerce Clause of the Constitution.

The justices, the government and the plaintiffs do not question the Constitutionality of requiring guaranteed  issue and community rating under the Commerce Clause.  All agreed that the so-called mandate is a “necessary” tool to provide guaranteed issue and community rating. All agreed that the sole issue rests on whether mandating the purchase of health insurance is a “proper” expansion of Congressional power.

The Supreme Court’s decision will have far reaching impact beyond the healthcare law as it will determine whether the Court will reverse the expanded interpretation of the Commerce Clause established during the New Deal. To gain insight into the likely outcome of Obamacare first requires examining how the planetary cycles of that era connect to the current one.

The New Deal era began when FDR was inaugurated on March 4, 1933. Uranus in Aries exactly squared Pluto in Cancer four days later, reflecting the revolutionary reforms that would be implemented by the new Administration to provide greater economic security to transform the health of the nation suffering from the Great Depression.

As the nation now slowly recovers from the Great Recession, Uranus is in Aries for the first time since then. Once again Uranus in Aries will exactly square Pluto (this time in Cancer’s opposite sign Capricorn) for the first time on June 24, 2012. It is around this time that the Supremes are expected to issue their ruling.

The birth of an individual, entity, or event carries the “DNA” of the planetary energies active at that moment in time.

Born March 15, 1933 in Brooklyn New York, Justice Ruth Bader Ginsburg is a child of the New Deal. Justice Ginsburg was born two days after Mercury the planetary energy of communication stationed retrograde in Aries – the same spot where Mercury stationed retrograde on March 12, 2012.

Aries’ planetary ruler Mars was retrograde in Virgo the sign ruling health matters, when Justice Ginsburg was born. Mars represents action. During the three days of oral arguments March 26-28, Mars in Virgo returned to its natal position when Justice Ginsburg was born. With natal Mars conjoining Neptune in Virgo, Justice Ginsburg argued to retain the law in its entirety. She also advocated that if any components were severed, the remainder of the law should be kept intact. The remaining components had value independent of the mandate. The tightness of the law’s integration took up much of the arguments.

As described in my post about Mars retrograde in Virgo, the last two times prior to now that Mars spent its entire retrograde cycle in Virgo was in 1965 and 1933.  Legislation passed during both of these eras expanded the social safety net.

Jupiter represents expansion and rules the courts. Justice Ginsburg’s natal Jupiter in Virgo conjoins the 1965 conjunction of Uranus and Pluto in Virgo which was the birth of their current cycle. FDR was an advocate of universal healthcare and so were subsequent Democratic administrations. A compromise was reached in 1965 to provide government healthcare for seniors (Medicare) and the poor (Medicaid). Obamacare has already expanded benefits to Medicare beneficiaries which would be rescinded if the law was struck down. On March 28, the Court heard oral arguments on expanding Medicaid to individuals without health insurance whose income is less than 133% of the poverty level.

As the Court’s senior liberal justice, with her Sun in Neptune-ruled Pisces opposite Jupiter in Virgo, Justice Ginsburg will play the lead role to convince the conservative justices to uphold the law in its entirety.

Justice Ginsburg’s natal Mercury in Aries reinforces this as it is being directly impacted by the current Uranus/Pluto square. Her natal Mercury conjoins Chief Justice Roberts’ natal Mars in Aries. Justice Ginsburg is the messenger speaking on behalf of the other liberal justices (Breyer, Sotomayer, and Kagan).

Chief Justice John Roberts was born with the Sun and Mercury in Uranus-ruled Aquarius. Aquarius/Uranus energies represent the unexpected. Born almost one month before Steve Jobs, the Chief Justice will carve out his own reputation on the Court for his ability to “think different” now and then.(1) Mercury in Aquarius squaring Saturn in Scorpio describes the Chief Justice’s conservative mindset. But with Mercury quincunx Uranus in Taurus, his mindset is not so rigid that there is no room for adjustment.

Saturn in Libra is squaring Chief Justice Roberts’ natal Jupiter and Uranus in Cancer. This can indicate the women on the Court led by Justice Ginsburg are exerting pressure on him to uphold the law by outlining the ramifications if the consumer protections and benefits the public is receiving are rescinded. Progressed Venus in Aquarius conjoining the Chief Justice’s natal Mercury is a further indication of the women justices desire to persuade him to agree.(2)

Justice Ginsburg’s natal Mercury in Aries opposes Justice Anthony Kennedy’s natal Moon in Libra. The ever changing mood of the Moon combined with Libra’s tendency to indecisiveness while having the ability to bridge the divide between two differing viewpoints, reflects Justice Kennedy being known as the “swing” vote. (His progressed Sun and Mercury are also in Libra.)

Planets in opposition to each other need to find common ground as a basis to work together as opposite signs share similar traits. Justice Ginsburg’s Mercury in Aries harmoniously aspects Justice Kennedy’s natal Venus in Leo; this can increase his receptiveness to her point of view. (Venus rules Libra and is the planetary ruler of his chart.) Justice Kennedy’s progressed Mars in Virgo conjoins Justice Ginsburg’s natal Mars, while his progressed Neptune in Virgo conjoins Justice Ginsburg’s natal Jupiter; both conjoin the 1965 Uranus/Pluto conjunction. While Justice Kennedy’s Venus in Leo squaring Uranus in Venus-ruled Taurus describes his love of individual liberty, natal Venus sesquiquadrate Saturn in Pisces can recognize that personal responsibility entails having everyone participate in the system since everyone is affected by an industry that consumes 17% of the nation’s GDP.

The Supreme Court was born when President Washington signed the Judiciary Act of 1789. The Sun in Libra the sign symbolized by the scales of balance and equal justice represents the Court’s purpose is to be fair and impartial. The Supreme’s Court’s natal Sun conjoins President Obama’s progressed Sun in Libra, reflecting that the President will forever be identified with the Court’s decision.

Progressed Venus and Saturn in Aries opposing the Libra Sun can indicate the women justices are pressuring the Chief Justice that the Court must prove to the public it is still capable of acting impartially. This is further reinforced by the Court’s progressed Venus and Saturn conjoining Chief Justice Roberts’ progressed Sun in Aries. These planets conjoin the Sun in Aries when President Obama signed the Affordable Care Act into law, and they will forever identify Chief Justice Roberts with Obamacare.

Obamacare completes what was left unfinished in 1965. When President Obama signed the bill into law two years ago, the Sun had just entered Aries and conjoined Uranus in Pisces. Both planets opposed Saturn in Libra as the Sun squared Pluto in Capricorn and the Moon in its home sign Cancer, formed a “cross” pattern indicating the new law would face many challenges on the journey to full implementation in 2014.

The Sun represents the President which is strong in the sector of the chart representing the Administration. The opposition from Saturn retrograde in the sector of the President’s political opponents describes their efforts to repeal the legislation to preserve the status quo as Saturn rules the sector of the chart representing the insurance industry. Saturn’s square to Pluto in Saturn-ruled Capricorn in the sector representing the President’s open enemies describes the wealthy donors and big business interests supporting the President’s political opponents. Saturn square Pluto indicates that a hidden agenda is a work. If the Supreme Court strikes down Obamacare, the ruling could be used to chip away at other regulations and social safety net programs such as Medicare, Medicaid, and Social Security.

The Moon represents the public and is the ruler of the Obamacare chart. The Moon’s square to the Sun, Mercury, Saturn, and Pluto reflects that public opinion about the law is highly emotionally charged and has been mostly influenced by the Administration’s opponents who have been far more effective in getting their message out. And because the major part of the law doesn’t begin until 2014, Obamacare’s opponents have used the time delay (Saturn retrograde) to their advantage. Yet opinion polls have consistently shown the public likes all the consumer benefits and protections but is more resistant to the “mandate.” The chart’s Ascendant exactly conjoining the USA and President Obama’s natal Venus in Cancer and the Moon conjoining the USA’s natal Jupiter in Cancer indicates the public will grow to like the law as more of the benefits and protections kick in. (3)

Saturn conjoining President Obama’s progressed Sun and the Supreme Court’s natal Sun describes the President’s confidence that the Court will uphold the law. Uranus in Pisces rules the sector of the law’s chart representing the courts and conjoins the Sun in the sector representing the Administration. Neptune in Aquarius rules the sector representing the Administration and is in the sector ruling the courts, exactly conjoining the USA’s natal Moon.

Both planets in the signs of each other’s rulership and Uranus and Neptune favorably aspecting each other reflect that all of the appellate processes upheld the law in its entirety except for the Atlanta district which only struck down the individual mandate provision of the law.(4)

Jupiter describes the Supreme Court. Jupiter in Neptune-ruled Pisces conjoining the sector of the Administration in the chart is an indication that the Supremes ruling will favor the Administration. Justice Ginsburg’s natal Venus in Pisces conjoins natal Jupiter, yet another indication of her influence on the Court to uphold the law. (Jupiter rules the sector in the chart representing health matters.)

The Supreme Court began three days of oral arguments on March 26 at 10:12 AM EDT. The chart for this time represents the Court’s opinion of the law. Mercury is the planetary ruler of the chart and is retrograde in Neptune-ruled Pisces. Pisces is symbolized by two fish swimming in opposite directions. Mercury retrograde in Pisces indicates that what the Justices said during oral arguments does not necessarily reflect how the Justices will rule. Mars retrograde in Mercury-ruled Virgo opposing Neptune in Pisces indicates the Justices actions could be the opposite of what their questions and comments implied.

Mercury retrograde reflects the justices are reviewing legislation that has already been in force for two years. Mercury retrograde can increase the potential for the law to be overturned. Yet with Mercury retrograde in the sector representing Congress quincunx retrograde Saturn in Libra conjoining the sector ruling healthcare, the difficulties of overturning the law where funding has already been allocated, spent, and commitments have been made to reimburse expenditures, and patient protections have already been issued.

In the interests of full disclosure, it has not been easy for me to examine this issue objectively as I am one of the thousands of individuals who would not have health insurance now if it wasn’t for the law’s Pre-Existing Condition Plan.

None of the justices have said that the “mandate” in and of itself was unconstitutional but Saturn in Libra squaring the USA natal Pluto in Capricorn describes the five conservative justices on the Court are concerned about a lack of boundaries on Congressional power.

It is my conclusion that Chief Justice Roberts will write the majority opinion to uphold Obamacare in its entirety. However, Mercury retrograde quincunx Saturn in the oral argument chart, Saturn opposite Uranus in the Obamacare chart, as Saturn in Libra squares the USA Pluto and Uranus in Aries squares Pluto in Capricorn, could indicate the justices limit precedent to this unique situation.

Wow what a good analysis... yes I hope they do uphold this act as it hasnt even had time to see if it works the healthcare companies are making 100's of billions in subsidies no wonder their stock charts and profits are so strong!

Readers might recall Obamacare was originally going to have a public option which was quashed by Dems such as Sen. Lieberman who receives most of his contributions from the industry.

After ranting in numerous editorials about how bad government healthcare is, The Wall Street Journal at the time wailed against the government option as the private health insurers would not be able to compete against a government option because it would cost less than private insurance!

Yet if government healthcare is so terrible, the Journal and private insurers would have had nothing to worry about. ;-)
